Taylor | Anderson represented a non-profit child-care center accredited by the National Association for the Education of Young Children (NAEYC). The center is located in San Diego, California and serves the families of military personnel and federal government employees.
The plaintiff was a minor who brought a lawsuit, through his mother, against the daycare center. The lawsuit alleged negligent hiring of teachers, negligent supervision of students, and that the plaintiff had been assaulted and abused – by other minors – while he was a student at the daycare center. The plaintiff’s settlement demand was $450,000.
In a motion for summary judgment, Taylor | Anderson lawyers argued that by law the center owed no duty of care to the plaintiff for fights between students. Furthermore, the plaintiff had failed to provide any admissible evidence to sustain his allegations.
On July 28, 2015, the court agreed by granting the motion and dismissed the entire case. The plaintiff subsequently filed a motion for new trial and a motion for reconsideration based on the error of the trial court. These motions were denied.
