Taylor | Anderson represented a rental car company in a personal injury/product liability action. Plaintiff alleged that the airbag in his rental car failed to deploy when he lost control of the car and hit a fence while pursued by police. He brought strict liability and negligence claims against the car manufacturer and the rental car company.
The trial court entered judgments (a) in favor of the rental car company after granting a motion for nonsuit at the conclusion of Plaintiff’s case-in-chief, and (b) in favor of the car manufacturer after a jury verdict in its favor. The verdicts were affirmed on appeal.
